Terms and Conditions for Test and Tag Services

Effective Date: 5th of May, 2025

These Terms and Conditions ("Agreement") govern the provision of test and tag services ("Services") by Test Monkey Test and Tag ("Company," "we," "us," or "our") to the customer ("Customer," "you," or "your"). By booking, receiving, or using our Services, you agree to be bound by these Terms and Conditions.

1. Services Provided

We provide electrical testing and tagging services in accordance with relevant safety standards to ensure your electrical appliances, tools, and equipment are compliant with safety regulations.

2. Bookings and Appointments

2.1. Bookings for Services can be made through:

2.2. The Customer agrees to provide accurate and complete information when booking the Services.
2.3. All appointments are subject to availability, and we reserve the right to reschedule services if necessary. We will inform the Customer promptly in the event of any changes.

3. Fees and Payment

3.1. The fees for our Services will be outlined in the quote provided to the Customer before the Service is performed.
3.2. The Customer agrees to pay the fees as detailed in the quote, which may include additional charges for travel, emergency service, or additional work performed outside the scope of the original agreement.
3.3. Payments are due upon completion of the Services, unless otherwise agreed in writing.
3.4. Payments can be made via bank transfer.
3.5. Late payments may incur a fee of 10% per month, and the Company reserves the right to suspend further services until outstanding payments are made.

4. Customer’s Responsibilities

4.1. The Customer agrees to provide safe and unobstructed access to the equipment to be tested and tagged.
4.2. The Customer is responsible for ensuring that the premises and the equipment are safe and free of any hazards that could impede the testing process.
4.3. The Customer is required to inform the Company of any specific requirements or circumstances that could affect the testing or tagging process (e.g., hazardous materials, equipment with specific handling instructions).

5. Testing and Tagging Process

5.1. All tests will be conducted in accordance with the relevant AS/NZS electrical safety standards.
5.2. The Company will perform the test and tagging of equipment as per the applicable Queensland regulatory guidelines.
5.3. The Company will provide a report detailing the test results, including information on any equipment that fails the testing process.
5.4. The Customer acknowledges that failure of equipment to pass the test may result in the need for repair or replacement, and the Company will not be responsible for any failure or defect in the equipment being tested.

6. Liability

6.1. The Company will take reasonable care to ensure that Services are provided professionally and in accordance with all applicable safety standards.
6.2. The Company’s liability is limited to the provision of the Services as described in this Agreement.
6.3. The Company will not be liable for any indirect, incidental, or consequential damages arising from the testing and tagging Services provided.
6.4. The Customer is responsible for maintaining insurance for any damages or losses that may occur as a result of faulty equipment.

7. Confidentiality

7.1. The Company will not disclose any confidential information provided by the Customer to third parties without prior written consent, unless required by law.
7.2. Any test results, reports, and customer information will be kept confidential and only shared with the Customer.

8. Termination

8.1. Either party may terminate the agreement by providing 48 hours notice in writing to the other party.
8.2. In the event of termination, the Customer agrees to pay for any Services provided up to the point of termination.

9. Force Majeure

9.1. Neither party will be held liable for any failure or delay in performing obligations due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, or government actions.

10. Governing Law

10.1. This Agreement will be governed by and construed in accordance with the laws of Queensland, Australia.
10.2. Any dispute arising from this Agreement shall be resolved through Mediation, in good faith, with representation from both parties.

11. Amendments

The Company reserves the right to modify or update these Terms and Conditions at any time. Any changes will be communicated to the Customer, and continued use of the Services will constitute acceptance of those changes.

By using our Services, the Customer acknowledges and agrees to these Terms and Conditions.
